Civil liberties

It's easy to have hoped that getting the Democrats back into power would have had the positive effect of reversing the trend in civil liberties erosion. Unfortunately, looking back at the context, a lot of things we're seeing now had their roots back in the last Democratic administration. We tend to forget that Clinton/Reno gave us the Communications Decency Act, Waco, the Clipper Clip, habeas corpus restrictions, storming Elian's house, etc. etc.. So, I wonder if its just something endemic to the system which got pushed into overdrive after 9/11, and it doesn't particularly matter which party is running things.
